By installing, registering for, activating a license for, or otherwise using Attendance App ("the Software"), you ("Administrator", "you", "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not install or use the Software. These Terms are between you and AIPL Gaytri Family ("we", "us", "our").
The Software is intended for use by a business or organization to record employee attendance using photo-based check-in/check-out submissions, and is administered by a single Administrator account per installation.
On first installation, the Software provides a 30-day free trial beginning from the installation date. No license file is required during the trial period.
After the trial period, continued use requires a valid license file, issued by us and tied to the specific computer ("Machine ID") on which the Software is installed. A license is valid for the subscription term stated in the license file (typically one year from issuance) unless otherwise agreed in writing.
Each license is bound to a single machine and is not transferable to another computer without our authorization. Attempting to use a license file on a machine other than the one it was issued for will cause it to fail validation.
You are responsible for renewing your license before it expires to avoid interruption of service. We are not obligated to provide advance notice of expiry, though the Software displays remaining trial/subscription days in the application.
You agree not to:
● Reverse engineer, decompile, or attempt to extract the Software's licensing or cryptographic logic;
● Forge, alter, or circumvent license validation, trial period tracking, or machine ID checks;
● Redistribute, sublicense, sell, or share the Software or your license file with unauthorized third parties;
● Use the Software for any purpose other than legitimate employee attendance tracking within your own organization.
Only one Administrator account may be registered per installation. You are responsible for:
● Choosing a secure User ID and Password (minimum 8 characters);
● Safeguarding your Authentication Code, which is required (together with a valid license) to recover a forgotten password - if you lose both your password and your Authentication Code, we may not be able to help you recover access to the account;
● All activity that occurs under your Administrator account;
● Promptly notifying us if you suspect unauthorized access to your account or license.
After 5 consecutive failed login attempts, the account is locked for 5 minutes as a security measure.
You agree to use the Software only for lawful purposes and in compliance with all applicable labor, privacy, and data protection laws in your jurisdiction. You are solely responsible for ensuring your use of the Software - including the collection of employee photographs, location data, and biometric identifiers - complies with local law.
The Software is designed to process the following categories of data about your employees:
● Photographs submitted for check-in and check-out, including facial images;
● Facial recognition data derived from enrollment photographs (biometric identifiers used to match attendance photos to enrolled employees);
● GPS location coordinates embedded in or extracted from attendance photographs;
● Timestamps, device-generated barcodes/QR codes, and derived attendance records (check-in/check-out times, leave, and rest schedules);
● Employee name, employee ID, and father's/family name, as entered by the Administrator.
YOU, AS THE ADMINISTRATOR, ARE SOLELY RESPONSIBLE FOR:
● Obtaining any consent, notice, or legal basis required under applicable law before enrolling an employee's face or collecting their location data;
● Providing employees with clear information about what data is collected, why, how long it is retained, and their rights over that data;
● Ensuring your use of biometric and location tracking is proportionate, lawful, and permitted under your local employment and privacy laws;
● Responding to any employee request to access, correct, or delete their data, and removing an employee's enrollment (including their stored facial embedding) when they leave your organization or withdraw consent.
AIPL provides the Software as a tool; we do not control what data you choose to collect or how you use it, and we are not a party to the employment relationship between you and your employees.
The Software stores all data locally on the computer where it is installed (attendance records, enrolled employee data including facial embeddings, leave/rest schedules, and Administrator credentials). No employee data is transmitted to us or to any third-party server by the Software itself.
Passwords and Authentication Codes are stored using one-way BCrypt hashing and are not recoverable by us. You are responsible for maintaining appropriate physical and technical security for the computer running the Software, including regular backups of the data folder. Loss of the data folder (through device failure, theft, or deletion) may result in permanent loss of attendance records and enrolled employee data, for which we are not liable.
The Software, including its source code, design, and underlying technology, is the property of AIPL Gaytri family and is protected by applicable intellectual property laws. This license grants you the right to use the Software; it does not transfer ownership of any intellectual property to you.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT FACE RECOGNITION, BARCODE/QR DECODING, OR LOCATION VERIFICATION WILL BE 100% ACCURATE UNDER ALL CONDITIONS (INCLUDING POOR IMAGE QUALITY, LIGHTING, OR COMPRESSION), AND YOU SHOULD NOT RELY ON THE SOFTWARE AS THE SOLE BASIS FOR DISCIPLINARY OR PAY-RELATED DECISIONS WITHOUT REASONABLE HUMAN REVIEW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIPL GAYTRI FAMILY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR CURRENT SUBSCRIPTION TERM.
You agree to indemnify and hold harmless AIPL Gaytri Family from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your collection or use of employee data in violation of applicable law; or (c) any dispute between you and your employees relating to data collected via the Software.
We may suspend or terminate your license if you violate these Terms, including attempts to circumvent license validation. You may stop using the Software at any time; these Terms survive termination with respect to any obligations that by their nature should continue (including Sections 8-10).
We may update these Terms from time to time. Continued use of the Software after an update constitutes acceptance of the revised Terms. We recommend checking this document periodically.
These Terms are governed by the laws of Republic of India without regard to conflict of law principles. Any disputes shall be resolved in the session Court of Ranchi, Jharkhand
